RISK CLASSIFICATIONS AND INTERVENTION REQUIREMENTS

In Illinois, drug/alcohol evaluations are required for individuals charged with DUI as part of sentencing. The evaluation determines the individual’s risk to public safety and provides a clinical recommendation for education and/or treatment. Each person is classified into one of four risk categories based on substance use history, BAC level at the time of arrest (when applicable), legal history, and symptoms of a substance use disorder. Each risk level is tied to a specific minimum intervention required by law:

  • Minimal Risk: Individuals with no prior DUI conviction, a BAC below 0.15, and no symptoms of a substance use disorder. The minimum requirement for this classification is 10 hours of DUI Risk Education.

  • Moderate Risk: Applies to individuals with a BAC between 0.15 and 0.19 or one symptom of a substance use disorder. These individuals must complete 10 hours of DUI Risk Education and at least 12 hours of early intervention for education and prevention.

  • Significant Risk: Assigned when an individual has one prior DUI-related conviction, a BAC of 0.20 or higher, or two to three symptoms of a substance use disorder. The intervention requirement includes 10 hours of DUI Risk Education, 20 or more hours of substance use treatment, and completion of a continuing care plan.

  • High Risk: Assigned when there are two or more prior DUI-related suspensions or dispositions, or when four or more symptoms of a substance use disorder are present. The required intervention includes a minimum of 75 hours of substance use disorder treatment and a continuing care plan.

Cloudgate Healthcare provides all the above services in an outpatient environment. Our documents are tailored to meet the standards outlined by the Illinois Department of Human Services Division of Substance Use Prevention and Recovery (SUPR), as well as the standards of specific courthouses and the Illinois Secretary of State.

COURT AND SECRETARY OF STATE DOCUMENTATION

Cloudgate Healthcare has extensive experience preparing and submitting documentation for both court sentencing compliance and Secretary of State hearings. Proper documentation is critical to ensuring compliance with legal and administrative requirements, particularly for those seeking license reinstatement through a formal or informal Secretary of State hearing. Our office routinely prepares and submits the following:

  • Drug and Alcohol Evaluations – Conducted by licensed professionals to determine risk classification and treatment needs for DUI-related offenses.

  • Treatment Needs Assessment – An in-depth review of an individual's clinical and legal background to determine appropriate care plans.

  • DUI Risk Education – Structured 10-hour educational program for individuals classified as minimum, moderate, or significant risk.

  • Early Intervention for Moderate Risk – Twelve-hour prevention program required for moderate risk classification.

  • Outpatient Drug and Alcohol Treatment Services – Evidence-based treatment for individuals with substance use disorders, including those with significant and high-risk classifications.

Our office also provides voluntary outpatient substance use treatment for individuals who are not mandated by court but wish to address substance use concerns proactively. Our services are delivered with professionalism, and confidentiality.
