OVERVIEW OF DUI EVALUATIONS IN ILLINOIS
Under Illinois law, individuals arrested for DUI are required to undergo a drug and alcohol evaluation as part of the court process. The evaluation must be completed by a licensed and approved provider and follows the format outlined in the Illinois Administrative Code, specifically 92 Ill. Adm. Code 2060.
A DUI evaluation is designed to determine an individual’s level of risk to public safety and assign an appropriate intervention requirement. This assessment includes a review of driving history, chemical test results (if applicable), criminal background, and a self-reported substance use history. The evaluation interview will also consider any potential DSM-V symptoms associated with substance use, medical history, and other clinical observations.
Following the evaluation, a classification is assigned: Minimal Risk, Moderate Risk, Significant Risk, or High Risk. Code Section 2060.505, the Risk Education program is a ten-hour course mandated for individuals classified as Minimal, Moderate, or Significant Risk. Risk Education is available in both individual and group formats with our agency. All group classes are facilitated by licensed professionals, and a certificate is provided for submission to the Will County court or Secretary of State upon successful completion of the course.
UNDERSTANDING DUI RISK CLASSIFICATIONS AND LEGAL REQUIREMENTS
Illinois law requires that the drug and alcohol evaluation for a DUI offense result in a classification that determines the minimum intervention needed. Risk levels are determined using criteria established under Illinois Administrative Code Section 2060. These classifications are as follows:
Minimal Risk
Applies to individuals with no prior DUI conviction, a BAC under 0.15, and no evidence of substance misuse. The minimum legal requirement is ten hours of DUI Risk Education.
Moderate Risk
Applies when the BAC was between 0.15 and 0.19, or when there is one symptom of a substance use disorder. The minimum required intervention includes ten hours of Risk Education plus twelve hours of early intervention.
Significant Risk
Assigned when there is one prior DUI or a BAC of 0.20 or greater, or when two to three symptoms of a substance use disorder are identified. The minimum legal requirement includes ten hours of DUI Risk Education, twenty hours of treatment, and a continuing care plan or waiver, if appropriate.
High Risk
Assigned when there are multiple prior DUI-related incidents or four or more symptoms of a substance use disorder. The legal requirement is a minimum of seventy-five hours of outpatient treatment and a continuing care plan or waiver, if appropriate.
